Cancellation Policy
Cancellation Policy: To help us fulfill our scheduling obligations to all students, and to maintain our schedule during our granted and approved pool permit hours,
please be aware of the following cancellation policy:
All cancellations must be communicated to swim@onewiththewater.org or via telephone: +1-323-364-SWIM.
1. Lessons cancelled with less than 24 hours notice WILL NOT receive a cancellation credit or refund. If a make-up class can
be rescheduled for your student, One with the Waterâ„¢ will accommodate make-up requests on a first-come first-served basis depending on
space available. Make-ups must be completed in the month the class was missed and cannot be carried over to the next month. Please
remember most weeks the schedule is full and there may not be space available to accommodate make-ups. Only 1 make-up per month is allowed.
2. Lessons cancelled with more than 24 hours notice will receive a make-up lesson.
3. No refunds will be given for any cancelled appointments or "no shows." There is a $50 fee for cancellations within the 24 hour period before the scheduled lesson.
4. On the rare occasion that One with the Waterâ„¢ cancels a lesson, due to circumstances beyond our control
(emergency pool closure, contamination, lightning, swim meet, etc.) you will be entitled to a make-up lesson.
Scheduled Vacations and School Breaks: We understand that many families will take trips or
vacations during the year and during school breaks. We request that you provide as much notice as
possible regarding these schedules, but at a minimum three weeks, so we can adjust the schedule accordingly.
STUDENT AGREEMENT & WAIVER OF LIABILITY
Tuition and Payments: Monthly membership fees are due on the first lesson. Monthly membership
payment reserves a student’s space in their scheduled lesson time(s) and if payment is not received,
a student’s spot will be opened to other students. Automatic payments can be made with a credit card
through our online registration process. If you prefer to pay by check, please make checks payable
to One with the Waterâ„¢ and bring it with you.
Waiting List: Families wishing to sign up for memberships when our schedule is full will be
added to a first-come first-served waiting list. When a membership space becomes available, we will
contact families in order, offering that time slot. Families who pass on a time slot due to a time
constraint will maintain their spot on the waitlist until a suitable lesson time becomes available.
Safety: Please do not allow your child to enter the pool until the instructor is present and
ready to begin the lesson. For lessons at the Santa Monica Swim Center or Culver City Plunge, the
pool may require that all children pass a swimming test to swim alone. Otherwise, a parent or guardian
must be within arm’s reach of the swimmer while in the pool. If your child is over 8 years of age and/or
has passed the swim test, they are allowed to swim in the splash pool by themselves. There is an additional charge for recreational swim.
Pool Contamination: In the event of a closure for pool contamination, we will do everything to
try to move the lesson to another pool. In the event pool space is not available, we will reschedule your
private lesson. Please understand that any closure due to contamination is done to protect the health and
safety of all swimmers and patrons. The type of contamination will determine the amount of time the pool
will be shut down. In order to help prevent contamination, we ask that all swimmers use the restroom before
entering the water. We also mandate that all swimmers under the age of 3 and any babies or swimmers who are
not potty trained wear an approved swim diaper (i.e. little swimmers).
Please do not allow swimmers to eat within 30 minutes prior to entering the pool, in order to allow the food proper time to digest.
Locker Room Etiquette: Please do not allow your child to “deck change†or change your child out of their
bathing suit on the pool deck. There are locker rooms for men and women and a family locker room. Please do not
bring a child of the opposite sex, above the age of 3, into the main locker room. Please use the family restroom
for dressing and other assistance.
Release from Liability
"I, the undersigned participant/ Parent of the participant, intending to be legally bound, hereby certify that
I am/my child is physically fit and have not been otherwise informed by a physician. I acknowledge that I am
aware of all the risks inherent in exercising (training and competition), including possible permanent disability
or death, and agree to assume all of those risks. As a condition of participation, I the undersigned, hereby assume
all risk of injury to my child/myself and absolve and hold harmless all coaches, members, officials, staff and
administrators of One with the Waterâ„¢ and/or any other facility or administering organizations from any and all
claims for losses injuries and/or all consequential damages including attorney fees incurred as a result of any
and all One with the Waterâ„¢ workouts, competitions, events and activities associated with One with the Waterâ„¢,
whether these losses, injuries and/or consequential damages occur as a result of my sole and/or partial negligence
and/or that of any and all coaches, members, officials, staff and administrators of One with the Waterâ„¢ and/or any
other facility administering organizations."
"One with the Waterâ„¢ of Santa Monica, California (“One with the Waterâ„¢â€) and the undersigned, parent(s)/guardian(s)
of the Participant, a minor (“Swimmerâ€), hereby enter into this Agreement for One with the Waterâ„¢ to provide a swim
program and/or lessons (“Programâ€) to Swimmer.
The undersigned represents and warrants the following:
--that Swimmer is in good physical condition and is not aware of any disease or injury that would result
in injury to Swimmer during the Program.
--that Swimmer is able to undertake all physical activities and use any facilities or equipment associated
with the Program.
--that there are inherent risks in Swimmer’s participation in the Program, including injuries, damages, and
losses of every nature, and do hereby authorize Swimmer to assume all such risks.
In the event that Swimmer should suffer an injury or illness, the undersigned does hereby grant permission
for the officials of One with the Water to have Swimmer transported to a medical facility for medical care
and treatment if deemed necessary, and further acknowledge that One with the Waterâ„¢ has no liability for any
costs incurred or damages suffered by Swimmer in connection with the provision of such medical care and treatment.
The undersigned hereby unconditionally waives and releases One with the Waterâ„¢, and all parents, affiliates,
successors, assigns, officers, directors, representatives, agents and employees thereof, from any and all claims,
damages, liability, actions or demands from injury or loss of any nature whatsoever, including any acts of negligence,
which Swimmer may have or which may hereafter accrue in connection with the Program.
This Agreement is binding on the undersigned, any personal representatives, assigns, heirs, and next of kin."
Enrollment Agreement: I have read and understand the information and policies for One with the Water and agree to
these terms as a condition for my student to participate as a team member with One with the Water.
